The term "brain damage" encompasses a wide variety of extremely serious injuries. More accurately, "brain damage" is mostly a general heading for a wide array of diverse serious injuries to the white and gray matter and connected nerves of the part of your body that dictates thought, speech, intelligence, memory, movement, personality, executive functioning, vision, balance, emotion and related functions.

The brain injury attorneys at Dansker & Aspromonte have handled hundreds of serious brain damage cases with results exceeding $100 million dollars in damage for our clients.

Our brain injury cases are extensive and include:

  • Comatose patients
  • Permanent vertigo
  • The loss of all sense of smell and taste
  • Fractured skulls
  • Reduction in IQ
  • Traumatic retardation
  • Traumatic epilepsy
  • Cognitive dysfunction
  • Brain hemorrhage
  • Swelling of the brain
  • Subdural hematoma
  • Cerebral palsy

Many of these injuries, such as a fractured skull or brain hemorrhage, are easy to identify and prove because they show up on an objective test such as an X-ray or MRI (magnetic resonance imaging).

The loss of IQ or a change in personality or executive functioning is much more complicated, as these would never be expected to show up on any film. Most often they are the result of a closed head injury where there is no skull fracture or bleeding. The injured party feels different and claims his or her memory or thoughts are impaired. The injured person seems confused, and calculations that were easy for him or her pre-accident become difficult or impossible after the head injury.

In these cases, proof requires multiple batteries of clinical psychological testing by a skilled clinical psychologist. Instead of an X-ray, a clinical psychologist administers written tests and uses the results to map or diagram the specific area of the brain affected.

The brain injury lawyers at Dansker & Aspromonte work with many of the top doctors in New York who provide this kind of testing.

We have a great deal of experience with closed head injuries cases, and we welcome your inquiries and questions about these serious injuries.
