A young theatre intern, 22, was walking across the intersection of 42nd Street and Ninth Avenue in Manhattan when she was suddenly struck by the rear gate of a passing flatbed truck which had flown open because it had been improperly secured by the driver. Initially, the plaintiff was treated and released by the hospital where she was treated for minor dental injuries and a concussion. However as the weeks passed, she felt funny and spaced out frequently. After several attempts she finally found a neurologist who diagnosed traumatic epilepsy which was directly caused by the accident.

At trial, Paul Dansker was able with the assistance of exceptional experts to prove that not only was the epilepsy caused by the accident but it was permanent and progressive, meaning getting progressively worse and was not able to be effectively treated for any length of time by existing medications.

A 43-year-old bookkeeper was walking along the water at the base of Manhattan in the pedestrian park known as Battery Park when she was struck by a speeding motorcycle. The police officer operating the motorcycle was on his way to a non-emergency event...directing traffic for a race being run downtown.

Angela was thrown 30 feet in the air and landed on her head. She sustained multiple skull fractures and internal bleeding in her brain leaving her with complete loss of smell and taste, emotional instability and permanent vertigo.

This case was in the news, both television and print when it came out that despite the gross negligence of the police officer, the City billed Angela for cost of the damage to the motorcycle!

Christian, 4, was brought to the hospital for a routine droopy eyelid repair. The hospital in a cost cutting measure had contracted out it's anesthesia services to a third party corporation who were saving money by employing mostly nurse practitioners instead of trained doctors to administer anesthesia. The nurse designated to anesthetize Christian was as it turned out was not even certified. Only minutes after the child was wheeled in, his heart stopped from an overdoes of Halothane gas and he ultimately was without oxygen for fifteen minutes. He had to be removed to another hospital where he had to be retrained to talk and walk again. Ultimately, at the time of trial eight years later, Christian was learning at a first grade level, couldn't tie his shoes or ride a bike. The Hospital doctors claimed that he either had an allergic reaction to the gas, or was that way before the incident or both. Regardless, the defendants ultimately agreed to settle at the end of a five week trial before the jury deliberated.

Most often they are the result of a closed head injury where there is no skull fracture or bleeding. The injured party feels different and claims their memory or thoughts are impaired. They seem confused and calculations which were easy for them pre-accident become difficult or impossible after a head injury.

In these cases, proof requires multiple batteries of clinical psychological testing by a skilled clinical psychologist. Instead of an X-ray, a clinical psychologist is able to map or diagram the specific area of the brain affected with psychological certainty using the results of the written tests they administer.
