FEATURED CASE

In this tragic case, a young mother took her newborn premature baby who had a cough and problems breathing to Jamaica Hospital. They treated the baby as if it was a simple respiratory infection. Instead it was RSV (Respiratory Syncytial Virus) which is an extremely virulent infectious process which is very dangerous to premature babies. The hospital staff failed to test for the virus and as a result, the baby stopped breathing and had a prolonged period of limited oxygen to his brain. He was ultimately diagnosed with Cerebral Palsy.

The matter was settled after jury selection and before openings. The money was placed in an annuity to help pay for the continued medical treatments that the boy will require for the rest of his life.

CEREBRAL PALSY

Dansker & Aspromonte are experienced brain damage attorneys who have recovered millions of dollars for their clients with cerebral palsy.

Cerebral Palsy is simply a tragedy. There are many causes for the disease but no matter what the cause, it is devastating for the child and the child's family. It is permanent and not reversible. The treatment is really supportive therapy to make the child comfortable but not better like other diseases.

Cerebral Palsy loosely means brain paralysis and actually refers to a wide range of disorders. CP affects the areas of the brain that controls muscle tone and motor activity. The severity of the presenting symptoms vary widely from mild to profound.

CP involves difficulty controlling muscles and can also include problems with balance, coordination, walking, speech, swallowing and in serious cases, mental retardation, breathing, bladder and bowel control, eating difficulties and in some cases even hearing and vision.

There are many causes for CP. In full term infants, the usual cause is prenatal, meaning before birth while the fetus is in the womb.

In premature infants, the risk of CP is much higher because the premature brain is at higher risk for bleeding and because the premature infant's lungs are not fully developed, they are more likely to develop serious respiratory distress which then causes periods of decreased oxygen to the brain.

Other causes of CP include blood clots, poor brain development, genetic disorders or stroke. Often the CP is naturally occurring and unavoidable. However, sometimes, it is a serious omission or a series of missteps by the medical providers to the mother, prenatally or by the OB during delivery or leading up to delivery or in treatment of newborns that causes this tragic and life altering condition.

In order to prevail in a medical malpractice action involving a child with CP, the plaintiff must prove that the cause of the CP was negligence on the part of the doctors or hospital staff. This is done through one or more expert physicians who explain to a jury in detail exactly what was done wrong and how that caused the tragedy.
