FEATURED CASES

A young theater intern, 22, was walking across the intersection of 42nd st and Ninth Ave in Manhattan when she was suddenly struck by the rear gate of a passing flatbed truck which had flown open because it had been improperly secured by the driver. Initially, the plaintiff was treated and released by the hospital where she was treated for minor dental injuries and a concussion. However as the weeks passed, she felt funny and spaced out frequently. After several attempts she finally found a neurologist who diagnosed traumatic epilepsy which was directly caused by the accident.

At trial, Paul Dansker was able with the assistance of exceptional experts to prove that not only was the epilepsy caused by the accident but it was permanent and progressive, meaning getting progressively worse and was not able to be effectively treated for any length of time by existing medications.

NOTE: It was an exceptionally good result given the fact that the plaintiff at the time of trial showed no signs of obvious injury or impairment and looked completely recovered.

A 43 year old bookkeeper was walking along the water at the base of Manhattan in the pedestrian park known as Battery Park when she was struck by a speeding motorcycle. The police officer operating the motorcycle was on his way to a non-emergency event...directing traffic for a race being run downtown.

Angela was thrown 30 feet in the air and landed on her head. She sustained multiple skull fractures and internal bleeding in her brain leaving her with complete loss of smell and taste, emotional instability and permanent vertigo.

This case was in the news, both television and print when it came out that despite the gross negligence of the police officer, the City billed Angela for cost of the damage to the motorcycle!

PEDESTRIAN ACCIDENTS

The highly experienced lawyers at Dansker & Aspromonte have recovered 100’s of millions of dollars for their clients, including many millions for pedestrians.

In our crowded city, pedestrians are literally everywhere, on every street and sidewalk, coming out of stores and office buildings, restaurants and ballgames.

Unlike suburban or country terrain, city life poses particular challenges to both pedestrians and drivers alike.

We live and work on top of each other in a jam-packed, dense environment. It's noisy, bright, teeming with life and motion.

For drivers, you never know when a kid chasing a ball will leap out in front of your car.

For someone walking across the street you never know when a cab will come too quickly around the corner. And sometimes you can do all the right things and still end up being hit by a careless driver. That's where Dansker & Aspromonte can help.

We have had enormous success over three decades representing pedestrians who most often through no fault of their own, end up suffering permanent debilitating injuries because a driver wasn't paying attention.

There are many rules that apply to pedestrians contained in the New York State Vehicle and Traffic Law and the New York City Traffic Regulations.

Did you know that even if a pedestrian is not walking in a crosswalk he can still recover damages if he is hit by a car? The law always requires a driver to keep an adequate look out and see what is there to be seen on the roadway. If a pedestrian is already walking across the street in plain view, even if not near the crosswalk, most often, the driver will be found responsible for the accident. And believe it or not, that would even apply where the light was not in the pedestrian's favor.

Each case is different. Every set of facts has to be analyzed with regard to the specific circumstances prevailing. But we at Dansker & Aspromonte are skilled at viewing the facts in the light most favorable to our client often times in a way that is unique and different from the other firms.
