Twenty-five percent of patients that died in ICUs at the hospital were misdiagnosed and missed diagnoses were present in another 28 percent of ICU patients. It was also concluded that eight percent of all deaths in the ICU were probably a direct result of the error in patient diagnosis. The study also targeted the main areas of misdiagnosis. One-third of the errors in ICU patient diagnoses occurred concerning pulmonary embolisms, heart attacks, pneumonia and the fungal infection known as Aspergillosis.

Surviving families of those deceased due to misdiagnosis are allowed by New York law to seek compensation for wrongful death. The challenge for families is proving that such negligence was the cause of death. Hospitals tend to protect their doctors and not disclose their negligent actions and even flat out deny that they have any liability.
