OMAR M. (AN INFANT) v. JAMAICA HOSPITAL SUPREME COURT: QUEENS COUNTY – PAUL DANSKER, TRIAL ATTORNEY – JUDGE JANICE TAYLOR

In this tragic case, a young mother took her newborn premature baby who had a cough and problems breathing to Jamaica Hospital. They treated the baby as if it was a simple respiratory infection.

Instead it was RSV (Respiratory Syncytial Virus) which is an extremely virulent infectious process which is very dangerous to premature babies. The hospital staff failed to test for the virus and as a result, the baby stopped breathing and had a prolonged period of limited oxygen to his brain. He was ultimately diagnosed with Cerebral Palsy.

The matter was settled after jury selection and before openings. The money was placed in an annuity to help pay for the continued medical treatments that the boy will require for the rest of his life.
