Types of Personal Injury Claims We Handle

Personal injuries can be the result of many types of accidents leading to all kinds of injuries. Our team handles cases related to all of them from motor vehicle accidents to dog attacks, slip and fall accidents, medical malpractice, nursing home abuse, and more. These accidents can lead to injuries that can take weeks, months, or years of recovery through ongoing medical treatments. In the most serious cases, permanent disability can result leaving lives changed forever.

Our Track Record

Our firm represents those who have suffered injuries of all kinds, including catastrophic injuries such as loss of vision, severe burns, loss of limbs, traumatic brain injury, and spinal cord damage. We have a proven track record of securing maximum settlements and court awards in the past three decades with more than $500 million won on behalf of our clients. Many of the settlements and verdicts have exceeded one million dollars in damages, such as the following:

  • $50 million for a medical malpractice case that resulted in brain damage
  • $31 million for a car accident case that resulted in serious injuries
  • $21.5 million for the wrongful death of a sanitation worker
  • $10.3 million for a pedestrian accident case where the victim was seriously injured by a truck
  • $8 million for victims of smoke inhalation from a fire
  • $6.6 million for a car accident case where a six-year-old passenger was injured

Once we review the specifics of your injury claim, we can estimate the settlement you could receive.

Potential Damages in a Queens Personal Injury Claim

Compensation from a personal injury claim may extend to both economic and non-economic losses. Economic damages are those that come with a specific monetary value, such hospital or other medical bills and invoices. Non-economic losses are subjective, meaning those without a cost specified by a bill or receipt. These damages have no measurements but must be determined in other ways.

Your potential damages in any claim will depend on the seriousness of your injury, your percentage of fault, and the evidence presented.

They can include:

  • Pain and suffering
  • Mental anguish
  • Permanent injuries
  • Lost wages
  • Lost work benefits
  • Lost earning capacity
  • Medical bills
  • Property damage
  • Disabled access modifications

While the kind of physical injuries you experience may differ from other individuals, emotional pain and suffering may also accompany each injury accident. Each case is unique and may also qualify for additional compensation not listed above. In cases where you have lost a loved one in an accident, a wrongful death claim can be pursued that results in different damages.

The Advantages of Hiring a Queens Personal Injury Attorney?

Putting a legal professional in the claim process has many benefits. We can take over all communication on your behalf with the insurance company. This alone is a significant benefit. While insurance company representatives may appear helpful, their main interest is in protecting their employer’s profitability. They may try to blame you to avoid liability. However, due to New York’s comparative negligence law, even if you are partially to blame, you may still be eligible for compensation.

In many cases, the insurer’s goal is to pay you off quickly and for as little as possible. Our team is here to work for you. We have no other purpose than to help you obtain the fair settlement you deserve.

Furthermore, we manage the entire legal process by doing the following:

  • Collecting all evidence related to the accident
  • Handling all insurance communications and filings
  • Identifying each party involved in the accident
  • Consulting with experts, such as accident reconstruction specialists, economic experts, and more to support your case
  • Negotiating a settlement in your favor
  • Taking your case to trial, if necessary

Long-Term Recovery in Personal Injury Claims

Initially, it may seem that all of your damages have been identified. However, sometimes hidden injuries have been inflicted that do not manifest until much later after an accident has occurred. These problems may surface later and indicate ongoing medical conditions that will result in continuous medical expenses.

For example, an initial diagnosis might not show every injury you sustained in your accident. As you heal, you will want to be sure that complications do not show up later. This is why it is important to seek medical attention immediately following an accident to connect all injuries related to the incident.

In all cases seeking compensation, your medical records are key to your case. Often, you must visit a physician several times to check your progress over an extended time period as you heal. This is critical to document the severity of the injuries that require long-term recovery.

The Basis of Personal Injury Claims

Personal injury falls under “tort” law. This means that it deals with wrongful actions committed against others generally based on negligence. These cases seek monetary damages as opposed to criminal penalties. To prevail in these cases, you must prove certain elements of the legal claim of negligence.

These elements include:

  • Showing that the at-fault party owed you a duty of care. As an example, all drivers owe everyone else on the road a duty to drive safely to avoid harm.
  • Showing that the duty of care was breached or violated. To continue the above example, a drunk driver violates the duty to drive safely and according to the law.
  • Showing that the breach caused the accident leading to your injuries.
  • Showing that you were harmed demonstrated by your medical bills, pain and suffering, and other “damages.”

These cases are handled in civil courts. Most, however, are settled outside of court through negotiation with the insurance companies. Only in cases where your best interests lie in going to trial do they end up in a civil courtroom.

Statute of Limitations

New York’s Civil Practice Law and Rules and other laws prescribe the different timelines in which various types of injury lawsuits must be filed. The failure to file your lawsuit within the deadline may prevent you from pursuing your claim and leave you with no recovery at all.

New York’s EPTL Section 5-4.1 states that wrongful death claims must be filed within two years from the time your loved one passed away. Many other factors can shorten the time to sue. Therefore, you should contact your Queens personal injury lawyer as soon as possible to protect your rights.
