Causes of Pedestrian Accidents

The New York Times analyzed crash data involving pedestrians injured or killed in traffic accidents in 2019. They found that some of the most common reasons for pedestrian accidents involve the negligence of motorists.

These include:

The At-Fault Driver Was Distracted

According to the analysis, the biggest factor that responding law enforcement officers attributed to fatal accidents was driver inattention or distraction. This cause represents 33 of the fatal accidents studied.

Driver distraction is anything that takes a driver’s mind off the task of driving, their eyes off the road, or their hands off the steering wheel, such as:

  • Texting and driving
  • Eating or drinking
  • Adjusting playlists or looking at directions on a phone or GPS
  • Adjusting dials in the car
  • Tending to children or pets in the car

The At-Fault Driver Failed to Yield

Twenty-six of the reviewed cases were attributed to a driver’s failure to yield. The New York Times’ analysis found that 60,000 people were injured in pedestrian accidents in New York City in 2019, many of which may also be due to the failure to yield.

The At-Fault Driver Drove Too Fast

Unsafe speed was attributed to five of the fatal accidents studied by the publication. New York drivers are expected to slow down as they approach intersections and crosswalks. However, many drivers disregard these rules.

The At-Fault Driver Disregarded Traffic Signs

Eight of the fatal accidents involved drivers who disregarded traffic signs. When a driver runs a red light or a stop sign, he or she may cause serious injuries to others. Such losses may leave victims with expensive medical bills, an inability to work, and chronic pain and suffering.

The At-Fault Driver Drove Carelessly

According to the analysis, other contributing factors that caused pedestrian injuries or deaths included:

  • Backing up unsafely
  • Driving under the influence of alcohol
  • Unsafely opening a door into traffic
  • Unsafe passing

Also, some drivers do not drive safely in areas where there is heavy foot traffic. For example, the New York Times found that one of Manhattan’s most dangerous cross streets involved pedestrians coming off the R.F.K. Bridge.

Pedestrian Injuries You Might Have Suffered

Pedestrians involved in accidents often suffer serious injuries, including:

Traumatic Brain Injuries

Pedestrian accidents can cause very serious injuries because of the vulnerable state a person is in when hit by a vehicle. In one case our firm handled, our client suffered a skull fracture and brain injury, and we were able to recover $6.3 million for her. In addition, we were successful in defending two appeals of the jury verdict, which resulted in the recovery of another $1.5 million in interest.

In another case, we represented a 22-year-old female pedestrian who was struck by the swinging rear door of a passing truck. She was diagnosed with traumatic epilepsy caused by the accident. Our Manhattan pedestrian accident lawyers secured $10.3 million in compensation for her.

Catastrophic Injuries

Pedestrian accidents can result in catastrophic and life-altering injuries, including:

Fracture injuries are extremely common after a pedestrian accident. One of our clients suffered from multiple fractures when she was hit by a speeding school bus. Her case was settled for $2.8 million after we located an eyewitness to the accident.
